Like any country, it’s illegal to start construction without obtaining a construction permit first in Thailand. If a building is built without apply for the permit first, the owner may face legal prosecution from Thai authority. In this article I will detail the steps in which building owners must take before and after construction.

What is a construction permit in Thailand?
Before you began building your house or factory in Thailand, you must obtain a construction permit with government agencies. This applies not only to building a new building, but also includes modifying existing buildings or factory, expanding existing buildings and demolishing buildings. Only after you get the construction permit may you began the construction process. Once you finished the construction, you must apply for approval. The government officer come to the construction site and inspect the building. If the building is built according to regulations, a permit will be granted to you.
Procedures of applying for construction permit in Thailand
Procedures for acquiring the construction permit in Thailand are as follows.
- We first start by gathering necessary documents (see “required documents”), write the application form and submit the application to the local district office.
- Officials of the local district office will check submitted building plan and document and verify with the city plan, construction code, seismic area and more.
- After the request has been checked and everything is in order, the applicant will receive a building permit. In the case that permission is not granted and revision is needed, the applicant must make corrections as informed by the official. And when finished editing, bring the document and submit the application to the local district office officer again.
- After the you received a license, as known as Or. 1. In addition to keeping the original documents You should also make a copy and archive.
- Once you receive the construction permit, you may begin the construction process. But keep in mind that you must build the building in accordance with the construction plan submitted to the office.
- After the construction is completed, you must inform the responsible officer to perform inspection on site. Once you the officer has inspected and the building is built in compliance with building code, the owner will receive a written building permit (Or. 6).

Required documents
The following documents are required to apply for a construction permit in Thailand.
- Copy of ID card (applicant and the owner), 1 set each
- Copy of house registration (applicant and land owner), 1 set each
- Documents showing land ownership (the land title deed or NS.3 copies), 2 sets
- Construction plans and attachment, 5 sets
- Copy of company registration certificate, 1 set
- Power of attorney from the land owner. (in the case of building a building on someone else’s land)
- Consent form from the land owner. (in the case of building a building on someone else’s land)
- Consent form to construct a building adjacent to the land (if any)
- Architect’s certificate
- Engineer’s certificate
- Declaration of supervision form from the architect
- Declaration of supervision form from the engineer
- Evidence or support document showing nearby land. (in the case of using a shared wall or build a building close to the land boundary)
- A copy of the house registration of the owner of the adjacent plot of land (if any)
- Copy of ID card of the owner of the adjacent plot of land (if any)
